Suit involves raid on Bosse RanchBy Catherine Bowers JACKSON—A civil suit seeking damages stemming from a raid on the Bosse Ranch last February, has been filed in a federal court by the KRL Partnership members, Roland Womack, Nadine Womack, Larry Womack, Luke Womack, and Renee Womack. The suite has been filed against Russell Moore with the California Highway Patrol; David Irey, special investigator for the San Joaquin District Attorney; Todd Riebe, Amador County District Attorney; and Ron Hall, special investigator with the local district attorney's office, as well as others yet unnamed. The defendants are being sued in both their individual and professional capacities. KRL is seeking compensation for "abuse of prosecution" through a jury trial, attorney fees for this and past litigation and for general, special, exemplary, and punitive damages, as well as other relief as the court deems proper. No dollar amount was specified in the suit. "I will let my attorney speak to this," Riebe said. Riebe was taken aback, he said, that the media had been informed of this action before the defendants had been served. KRL Partnership members who were contacted, said there has been a "gag order" served on them about this suit, so they also had no comment. The KRL Partnership civil action at this time is understood to be independent of the pending criminal case against Robert Womack (father of three members of the partnership) under criminal investigation by the local district attorney for allegedly illegally removing a gas tank from a former filling station site in May, 1998. Mark Sherrill is also facing charges stemming from the same alleged gas tank removal incident. Charges against a third defendant, David Mason III, were dropped. The Bosse Ranch was the subject of a two-day excavation project initiated by county investigators in which large, holes were dug while searching for evidence of alleged environmental contamination. According to property owner Luke Womack, repairs to water and electrical lines damaged during the excavation were never made by county officials. The holes have never been filled. Family members attempting to repair the damages to the site were stopped by officials and permits have been refused, according to friends of Luke and Renee Womack, property residents. Other civil rights actions in association with this case and the Womack case are pending, according to attorneys for other principals in this part of the KRL case.
