Gas tank hearing continues Friday

JACKSON—A number of witnesses are expected to be called Friday during the continuation of the evidentiary hearing into the gas tank prosecution of three Amador County men.

Beginning at 9 a.m. in Amador Superior Court, prosecuting attorney David Irey will be called on to support the probable cause statements used in obtaining a search warrant for the first all-day Oct. 30, 1998 search of the Robert Womack home on Ridge Road. Womack was charged with 21 felony counts involving a May 1998 removal of a underground service station tank. A second search was conducted in January, 1999.

Womack's attorney is calling the first search illegal and suggests that information seized in the search was aired before a special grand jury and the illegal "fruits of that search" were used to draft the 21 charges, originally brought against Womack, which were not centered anymore on the alleged illegal tank removal.

Expected to testify is Gary Roush, a former City of Jackson employee who issued Womack the May demolition permit.

Michael Israel, county environmental official and Bob Fourt, who heads the county's administration of the state underground storage tank program were awaiting their time to testify last week. Time ran short and they were not called. They are expected back again for testimony Friday morning.

Russell Moore, a California Highway Patrol investigator from Stockton is also expected to be called. Moore handled everything from October 22, 1998 forward, including the two-day excavations for a 60-foot trailer at the Luke Womack home (nee Bosse Ranch) east of Jackson.
