By Diane Smith JACKSON—Three witnesses were heard yesterday in an all-day evidentiary hearing concerning the alleged illegal removal of a gas tank here in may of 1998. The hearing thus far addressed whether there was justification for a search warrant on the home of Robert Womack, a defendant in a criminal case stemming from a special grand jury indictment. George Ryan of Western Title Company was the first witness called in an evidentiary hearing which started at 9 a.m. and continued through most of the afternoon. Ryan handled the title work for the proposed sale and transfer of property at 505 Sutter Street, owned by Dave Mason. To date, the property has not been transferred. At mid-afternoon, Amador District Attorney's investigator Ron Hall took the stand and was quizzed on his investigation leading up to presenting a judge with a request for an October 1998 search warrant, one of two searches undertaken at the Robert Womack home. The issue, as Judge John Cruikshank repeatedly pointed out was whether there was cause for search warrants or whether the judge was mislead with inappropriate justification by the prosecution. The last witness for the long day was Gary Clark, Amador Land Use Agency Director who answered questions about his role in the case and his grand jury testimony.
