CPA claims records still being withheld

JACKSON—An extension of time application has been filed this week with the Internal Revenue Service by KRL Partnership. Tax records confiscated last year in search and seizure raids on various sites have not been returned. An Amador Superior Court Judge is expected to render a decision on the return of tax records requested by attorneys for Robert Womack and for his adult children.

Records were seized for investigation purposes, according to the principals in a case alleging Robert Womack and others committed felonies by removing in May of last year, a gas tank from a former Jackson service station site.

KRL is the partnership of the adult Womack children, none of whom have been charged with any offenses. Their records however were taken from their storage at their parents', June and Robert Womack's home during several raids conducted under the auspices of the Amador County District Attorney's Offices.

The reason given for the extension request to IRS by their Fair Oaks accountant was that the county has "accused the taxpayer of certain wrongdoings. In their investigation, they have taken all the clients' records and all the CPA's records that relate to the clients financial matters. Without these records it is impossible to complete the 1998 income tax returns. The case goes before a judge on 6-25-99 and it is expected that the case will be thrown out because there is no evidence of wrongdoing. At that point, it is expected all records will be returned and taxpayer will be able to complete the tax returns."

The office of accountant David Olmstead was also raided and his computer equipment and all his clients records were seized in a surprise raid months ago. Records of other clients were returned after he hired an attorney to get them back but Womack family records are still being withheld by the Amador County District Attorney's Office.
