Wolin pleads 'no contest'

JACKSON—Stockton Judge John Cruikshank sat in Amador Superior Court this week and handed out a lighter penalty than had been requested for William Wolin Jr. and Sr. and Wolin and Sons Inc.

In an arraignment proceeding, the Wolins pleaded "no contest" to a single misdemeanor Health and Safety Code charge of illegally removing and disposing of hazardous waste materials.

District Attorney Todd Riebe has agreed not to file any additional criminal charges against the Wolin business or the Wolins.

The charge stemmed from the investigation of a fuel tank removal in the City of Jackson in May of 1998, adjacent to the business office of Roland Womack, DDS.

Conditions of the plea agreement include: obeying all environmental and zoning laws, three years probation, and health and safety instruction in hazardous materials handling.

The Wolins will have to pay $2,000 to the Amador County Environmental Health Department for education of citizens in underground storage tank and hazardous materials handling.

Additionally, Judge Cruikshank agreed to the D.A.'s terms for educating Wolin employees. But his instructions were that defendants were to pay for "eight hours' training of no more than $400 for one eight-hour session for 12 employees." The Wolins must complete 40 hours of hazardous material training.

Riebe and Special Prosecutor David Irey had filed April 30 for all of the above plus an undisclosed amount for investigation reimbursement to various entities, including the plaintiffs, the People of California, Amador Environmental Health Department, California Highway Patrol, California Department of Toxic Substances and "the Amador Community Development Department."

A check at the county administration building reveals no listing for the latter.
